The official website accessible at https://www.tahiti2027.pf (hereinafter the “Site”) is dedicated to the promotion, information, and institutional communication relating to the Pacific Games - Tahiti 2027 (hereinafter the “Games”), a sporting competition organized by the PACIFIC GAMES ORGANISING COMMITTEE - TAHITI 2027.

In particular, the Site is intended to present the event, its news, its disciplines, its programs, its mobilization initiatives, its associated services, as well as any digital tools implemented as part of the organization and promotion of the Games.

Any person accessing, browsing, or using the Site acknowledges having read these Terms and Conditions of Use (hereinafter the “Terms”) and accepts them without reservation.

The purpose of these Terms is to define the conditions under which Users may access the Site and use the content, services, tools, forms, digital spaces, and features made available on it.

They also govern the respective rights and obligations of:

Article 3 - Definitions

For the purposes of these Terms, the following terms shall have the meanings assigned to them below:

  • “COJ” or “Publisher”: the PACIFIC GAMES ORGANISING COMMITTEE - TAHITI 2027
  • “Site”: the official website accessible at https://www.tahiti2027.pf as well as, where applicable, its subdomains, associated pages, sections, and related interfaces
  • “User”: any natural or legal person accessing, browsing, or using the Site in any capacity whatsoever
  • “Services”: all features, content, forms, spaces, interactive services, modules, or tools accessible from the Site
  • “Content”: all elements making up the Site, including text, visuals, photographs, videos, sounds, animations, logos, trademarks, documents, databases, interfaces, graphic charters, software, and more generally any protected element or any element used on the Site

They also apply, unless otherwise specifically provided, to any related service offered on or via the Site, including:

  • volunteer area
  • application area
  • contact area
  • press area
  • partners area
  • accreditation area
  • media area
  • information services
  • newsletter

any other area or feature made available online in connection with the Games.

Where certain Services are subject to specific conditions, such conditions shall supplement these Terms and shall prevail in the event of any inconsistency.

Article 5 - Acceptance of the Terms

Access to and use of the Site imply full, complete, and unconditional acceptance of these Terms.

Such acceptance shall be deemed acquired:

  • upon the first consultation of the Site

and, where applicable, by any express validation through a checkbox, confirmation button, or any other equivalent affirmative action.

The User acknowledges having the legal capacity required to accept these Terms or, failing that, to act under the responsibility of their legal representative.

Article 6 - Amendment of the Terms

The COJ reserves the right to amend, at any time, without prior notice and at its sole discretion, all or part of these Terms, in particular in order to:

  • take into account legal, regulatory, or case law developments
  • adapt the Site to technical or functional developments
  • strengthen the security, compliance, or terms of use of the Site

incorporate new services or digital tools.

The applicable Terms are those in force on the date the Site is consulted or used.

It is the User’s responsibility to consult the latest version regularly.

Article 7 - Description of the Site and Services

The main purpose of the Site is to publish official information relating to the Games and to offer, depending on organizational needs, related content and digital services.

In this respect, the Site may in particular allow:

  • institutional presentation of the Games
  • publication of news and official information
  • publication of schedules, programs, announcements, press releases, results, or editorial content
  • access to contact or participation forms
  • submission of applications or registrations for certain programs
  • redirection to third-party services or partner platforms

access to restricted or secure areas.

The COJ remains free to modify, supplement, suspend, or remove all or part of the Site or the Services at any time and without prior notice.

Article 8 - Access to the Site

In principle, the Site is accessible 24 hours a day, 7 days a week.

However, the COJ does not guarantee permanent access, continuous availability, or the total absence of errors, bugs, interruptions, or malfunctions.

The COJ reserves the right to suspend, interrupt, restrict, or limit access to all or part of the Site, without prior notice, in particular for the purposes of:

  • maintenance
  • updates
  • security
  • technical corrections
  • functional developments
  • protection of information systems

or in the event of force majeure.

Article 9 - Technical Conditions of Use

The User acknowledges having the technical means and skills necessary to access and use the Site under normal conditions.

In particular, the User is responsible for:

  • ensuring the compatibility of their equipment and software
  • having an adequate internet connection
  • keeping their equipment, browsers, and systems up to date

protecting their devices against any malicious program, intrusion, alteration, or unauthorized use.

All costs related to access to the Site (hardware, software, internet connection, communications, subscriptions) remain the exclusive responsibility of the User.

Article 10 - User Account and Login Credentials

Where access to certain Services requires the creation of an Account, the User undertakes to:

  • provide accurate, truthful, complete, and up-to-date information
  • not impersonate any third party
  • keep their login credentials confidential
  • not disclose their access details to third parties

promptly report any fraudulent, unauthorized, or suspicious use of their Account.

The User remains solely responsible for any use of their Account and credentials, unless they prove fraudulent use beyond their control.

The COJ reserves the right to suspend, restrict, or delete any Account in the event of:

  • non-compliance with these Terms
  • fraud or attempted fraud
  • harm to the security of the Site
  • abusive or unlawful conduct
  • provision of inaccurate information

prolonged inactivity, subject to applicable rules.

Article 11 - General Obligations of the User

The User undertakes to use the Site:

  • in good faith
  • in accordance with its intended purpose
  • in compliance with applicable laws and regulations

without infringing the rights, interests, image, or security of the COJ or any third party.

In particular, the User shall refrain from:

  • using the Site for purposes other than those for which it is intended
  • attempting to gain unauthorized access to protected areas or data
  • compromising or attempting to compromise the security, integrity, or operation of the Site
  • introducing viruses, malicious scripts, harmful programs, or similar devices
  • extracting, reproducing, or massively scraping data or content from the Site
  • publishing or transmitting any unlawful, defamatory, insulting, hateful, obscene, discriminatory content, or content infringing the rights of third parties

harming the reputation, image, or interests of the COJ, the Games, athletes, institutions, or partners.

Article 12 - Accuracy of Information

The COJ endeavors to ensure the reliability, consistency, and updating of the information published on the Site.

However, the User acknowledges that:

  • the published information is provided for informational purposes only
  • it may be provisional, evolving, or subject to change

it cannot be guaranteed to be exhaustive, error-free, or always updated in real time.

Consequently, the User remains solely responsible for how they use the information consulted on the Site.

No information appearing on the Site shall be construed as constituting, unless expressly stated otherwise, a firm contractual commitment by the COJ.

Any calendar, program, sports schedule, list of disciplines, logistical organization, participation scheme, registration procedure, recruitment schedule, or mobilization timeline may change without prior notice.

Article 13 - Intellectual Property

The Site and all the elements comprising it are protected by the applicable intellectual property laws and regulations.

The following are notably protected:

  • the architecture of the Site
  • its structure
  • its interfaces
  • its texts
  • its editorial content
  • its visuals
  • its videos
  • its photographs
  • its documents
  • its databases
  • its software
  • its graphic charters

its distinctive signs.

Unless expressly stated otherwise, these elements are the exclusive property of the COJ or their respective right holders.

No ownership or exploitation rights are transferred to the User solely by virtue of consulting the Site.

Any reproduction, representation, distribution, adaptation, modification, extraction, republication, translation, exploitation, or reuse, in whole or in part, of the Site or any of its elements, without prior written authorization, is strictly prohibited.

Article 14 - Trademarks, Logos, and Identity of the Games

The names, logos, emblems, signs, visuals, graphic identities, slogans, charters, and distinctive elements relating to the Games or the COJ are protected.

Any use, reproduction, imitation, distribution, or exploitation, in any form whatsoever, without prior written authorization, is strictly prohibited.

Any infringement of these rights may give rise to any appropriate action, including legal proceedings.

Article 15 - Databases

The COJ and/or its partners may claim the status of producer of the databases accessible on the Site.

Consequently, any extraction, reuse, making available to the public, reproduction, representation, or exploitation of all or a qualitatively or quantitatively substantial part of the databases accessible on the Site, including on a repeated and systematic basis, is prohibited without prior authorization.

Article 16 - Hyperlinks

16.1 Links to the Site

The creation of hyperlinks to the Site’s homepage is permitted provided that it:

  • is fair
  • does not create any confusion as to the origin of the content
  • does not suggest any unauthorized endorsement, affiliation, or official approval

does not harm the image or interests of the COJ.

The following are prohibited in particular, unless prior written authorization has been obtained:

  • deep links
  • framing
  • inlining

any integration of the Site or its content into a third-party environment likely to create confusion.

16.2 Links to Third-Party Services

The Site may contain links to third-party websites, applications, platforms, or services.

The COJ exercises no control over such external services and disclaims all liability regarding:

  • their availability
  • their content
  • their security
  • their compliance
  • their privacy policies

their terms of use.

The User accesses these services under their sole responsibility.

Article 17 - Content, Messages, and Information Submitted by the User

Where the Site allows the User to submit data, messages, applications, documents, files, forms, comments, or any other content, the User warrants:

  • that they are entitled to communicate them
  • that they hold the necessary rights or authorizations

that they are accurate, truthful, lawful, and appropriate for their intended purpose.

The User remains solely responsible for the elements they submit.

The COJ reserves the right, at any time, without prior notice or compensation, to refuse, moderate, delete, or not process any content or transmission that is:

  • non-compliant with these Terms
  • incomplete or inaccurate
  • contrary to the law
  • inappropriate for the purpose of the relevant service

or infringing the rights or interests of the COJ or a third party.

Article 18 - License to Use Submitted Content

Unless otherwise specifically provided, the User grants the COJ, on a non-exclusive, free-of-charge, worldwide basis and for the period necessary for the relevant purpose, the right to reproduce, record, process, format, archive, and technically use the content and information submitted via the Site, strictly to the extent necessary for:

  • processing the User’s request
  • the administrative or operational management of the Games
  • the security of the Site
  • regulatory compliance
  • archiving and evidentiary purposes

service improvement.

This license does not constitute a general assignment of the User’s intellectual property rights.

Article 19 - Personal Data

The COJ may collect and process personal data in connection with the operation of the Site and the provision of the Services.

Such processing is carried out in accordance with the applicable data protection regulations.

The detailed arrangements relating to:

  • the purposes of processing
  • the legal bases
  • the categories of data collected
  • the recipients
  • the retention periods
  • the security measures
  • the rights of data subjects

and how to exercise those rights

are set out in a separate Privacy Policy accessible on the Site.

Users are invited to consult it carefully.

Article 20 - Cookies and Trackers

The use of such services may be subject to specific conditions, which supplement these Terms.

Users are invited to read them before any use.

Article 23 - Social Networks and External Content

The COJ may publish, relay, or integrate on the Site content originating from social networks, external feeds, video players, widgets, or third-party modules.

The use of these features may result in the application of contractual terms specific to the relevant platforms, as well as data collection operations carried out by those third parties.

The COJ shall not be liable for processing operations, content, removals, blocking measures, policies, or decisions falling under the responsibility of such platforms.

Article 24 - Specific Provisions Relating to Ticketing

Where the Site directly or indirectly offers a ticketing service enabling the purchase, reservation, issuance, management, or download of admission tickets for competitions, ceremonies, activities, or any other event related to the Games, the User acknowledges that access to such service may be subject to additional specific conditions, which shall apply cumulatively with these Terms.

24.1 Terms of Sale

Any order for a ticket or admission pass made via the Site or through an authorized ticketing platform constitutes full and unconditional acceptance of:

  • these Terms
  • any applicable specific ticketing conditions

as well as the rules specific to the competition venues and the relevant organizers.

Tickets are sold subject to availability.

The COJ reserves the right to refuse, limit, cancel, or suspend any order for legitimate reasons, in particular in the event of fraud, attempted fraud, non-compliance with applicable conditions, payment incident, technical malfunction, manifest error, or suspected abusive use.

The sale shall only become final after definitive confirmation of the order and, where applicable, full payment of the price.

24.2 Seating

Depending on the nature of the competitions, venues, and price categories, tickets may correspond to:

  • either a numbered seat
  • or a seating category

or unnumbered access, within the authorized capacity limits.

The COJ reserves the right, for organizational, security, technical, production, broadcasting, protocol, safety, or operational reallocation reasons, to modify the initially planned seating allocation, provided that, where possible, an equivalent or appropriate solution is offered.

No claim may be accepted solely on the basis of a seating change made necessary by organizational or security requirements.

24.3 Access Control

Access to competition venues, ceremonies, or event spaces is subject to the presentation of a valid, legible, authentic ticket corresponding to the relevant session or event.

The COJ, its agents, service providers, security forces, authorized personnel, or site operators may carry out any useful checks, including:

  • ticket verification
  • visual inspection
  • identity checks, where necessary or authorized
  • inspection of personal belongings, in compliance with applicable regulations

verification of compliance with access conditions.

The User acknowledges that an admission ticket that is:

  • incomplete
  • damaged
  • illegible
  • forged
  • already used
  • acquired in breach of the applicable conditions

or presented by an unauthorized person

may be refused without refund or compensation.

24.4 Refunds and Cancellations

Unless otherwise required by mandatory law or by more favorable specific conditions, any purchased ticket may not be taken back, exchanged, or refunded, notably in the event of loss, theft, forgetfulness, personal inability to attend the event, or purchaser convenience.

In the event of the total cancellation of a competition or event by the COJ, the terms of refund or credit note shall be determined in accordance with the applicable specific ticketing conditions.

In the event of postponement, program changes, time changes, venue changes, interruption, format adjustment, partial or total closed-door arrangements, capacity restrictions, or any measure imposed for organizational, health, security, climatic, technical, or regulatory reasons, the COJ shall determine the applicable measures, which may include the absence of a refund where the event is substantially maintained.

No refund shall be due where the holding of the event is prevented, altered, or restricted by force majeure or by any decision of the competent authorities.

24.5 Prohibition of Resale

Unless expressly authorized by the COJ or carried out through an official resale platform that it may designate, any resale, transfer for consideration, offer for resale, promotional use, commercialization, distribution for advertising purposes, or commercial exploitation of tickets is strictly prohibited.

The COJ reserves the right to:

  • cancel any ticket resold or acquired in breach of this prohibition
  • refuse access to the holder of the relevant ticket

take any appropriate action against the persons involved.

24.6 Fraud

Any fraud, attempted fraud, or unlawful use relating to ticketing, including in particular:

  • ticket counterfeiting
  • duplication
  • impersonation
  • payment fraud
  • unauthorized resale
  • use of automated purchasing tools
  • artificial creation of order volumes

circumvention of purchase limits

may result, without prejudice to any civil or criminal action, in:

  • cancellation of orders
  • suspension or deletion of the relevant Account
  • refusal of access to venues

reporting to the competent authorities.

24.7 Security at Competition Venues

Access to competition venues, ceremonies, and any space related to the Games requires strict compliance with:

  • safety instructions
  • the internal regulations applicable to the relevant venue
  • the instructions of authorized personnel
  • circulation, seating, and evacuation rules

prohibitions regarding certain objects or behaviors.

The COJ reserves the right to refuse access to or remove any person who:

  • disturbs public order
  • adopts dangerous, violent, insulting, racist, discriminatory behavior, or behavior contrary to the spirit of the Games
  • is intoxicated or under the influence of prohibited substances
  • possesses prohibited objects

or refuses to submit to authorized checks.

Such measures may be taken without refund or compensation.

Article 25 - Specific Provisions Relating to the Press Area

Where the Site provides a press or media area, it is intended exclusively for journalists, press organizations, photographers, broadcasters, agencies, producers, media partners, and other duly authorized information or communication professionals.

Access to this area may be subject to registration, prior validation, accreditation, or recognition of professional status.

25.1 Conditions of Use of Photos, Videos, and Results

Photographs, videos, press releases, press kits, results, statistics, graphic elements, and more generally all content made available in the press/media area are provided exclusively for information, editorial coverage, and journalistic communication relating to the Games.

Unless expressly authorized otherwise, their use is strictly limited to:

  • the needs of editorial coverage of the Games
  • while respecting their integrity
  • with mention of the required credits, copyrights, captions, and sources

without altering their meaning, context, or scope.

The COJ reserves the right to set specific conditions of use, citation, integration, distribution, or republication for certain content.

25.2 Embargo

Certain content, press releases, announcements, results, visuals, key messages, data, or documents made available in the press/media area may be subject to embargo.

In such case, the authorized User shall refrain from publishing, distributing, relaying, commenting on, or using such content before the date and time of the lifting of the embargo expressly indicated.

Any breach of an embargo may result in:

  • immediate withdrawal of access to the press/media area
  • withdrawal or refusal of accreditation
  • any useful protective measure

and, where applicable, any action for liability.

25.3 Editorial Restrictions

The use of content provided in the press/media area must respect:

  • the truthfulness of the facts
  • the rights of individuals
  • the dignity of participants
  • the image of the Games
  • applicable professional rules

restrictions imposed by rights holders, broadcasters, federations, or partners.

Unless expressly agreed otherwise, it is prohibited:

  • to use the content in a misleading, defamatory, disparaging, or unlawful context
  • to associate it with unauthorized advertising, political, activist, or sponsorship messages
  • to substantially modify, distort, truncate, or re-editorialize it in a way that alters its meaning

to imply official approval by the COJ where none exists.

25.4 Commercial Use Prohibited Without License

Unless covered by a specific license, prior written authorization, or express contractual provision, any commercial use of the photos, videos, results, data, trademarks, logos, media content, or archival materials relating to the Games is strictly prohibited.

The following are notably prohibited, without this list being exhaustive:

  • sale of content
  • integration into products or paid services for a commercial purpose other than normal authorized editorial use
  • advertising or promotional use
  • creation of derivative products
  • unauthorized commercial syndication

any transfer or sublicensing to third parties.

The COJ reserves the right to require the immediate removal of any content used in violation of this article and to take any appropriate action.

Article 26 - Specific Provisions Relating to Accreditations

The Site may allow the submission, processing, management, or tracking of accreditation applications for the Games.

Accreditations are personal, temporary, revocable, and strictly regulated authorizations, issued for specific needs of access to certain areas, functions, or services.

Submitting an accreditation application does not confer any vested right to obtain one.

26.1 Accreditation Categories

The COJ reserves the right to freely define the applicable accreditation categories, including for:

  • media
  • delegations
  • athletes
  • technical officials
  • partners
  • service providers
  • suppliers
  • volunteers
  • institutions
  • guests

or any other category deemed relevant for the organization of the Games.

Each category may give rise to distinct access rights, specific restrictions, particular conditions of use, and limited circulation areas.

26.2 Required Documents

Any accreditation application must be accompanied by the information and documents required by the COJ, which may include in particular:

  • identity document
  • ID photograph
  • proof of assignment, function, or status
  • assignment letter or mandate
  • administrative or professional documents
  • certificates
  • authorizations

additional documents necessary for processing, security, or compliance.

The applicant guarantees the accuracy, authenticity, and currency of the elements submitted.

Any incomplete, inaccurate, misleading, or irregular file may be refused without compensation.

26.3 Checks

The COJ may at any time carry out checks relating to:

  • the identity of the holder
  • the validity of the accreditation
  • the compliance of the documents produced
  • the reality of the claimed assignment
  • compliance with safety, circulation, and conduct rules

the actual use of the badge.

Such checks may be carried out before issuance, upon collection, at venue entrances, during the Games, or upon access to any regulated area.

The accreditation holder undertakes to fully cooperate with such checks.

26.4 Refusal, Suspension, and Withdrawal

The COJ reserves the right, at its sole discretion, to refuse, suspend, limit, deactivate, or withdraw any accreditation, in particular in the event of:

  • an incomplete or irregular file
  • false or misleading information
  • breach of these Terms or of the applicable specific conditions
  • non-compliance with safety instructions
  • conduct incompatible with the proper conduct of the Games
  • operational, organizational, disciplinary, or regulatory necessity

risk to the safety, image, or integrity of the Games.

A refused, suspended, or withdrawn accreditation shall not give rise to any compensation, refund, or damages, unless required by mandatory provisions.

26.5 Rules for Use of Badges

Any badge or accreditation pass:

  • is personal
  • may not be lent, transferred, reproduced, or falsified
  • must be worn or presented in accordance with the COJ’s instructions
  • remains the property of the COJ

may be returned upon first request.

The holder shall refrain from:

  • allowing a third party to use their badge
  • altering, concealing, or damaging identification elements
  • accessing unauthorized areas

using the accreditation for purposes unrelated to their assignment.

Any improper or fraudulent use may result in the immediate withdrawal of the badge, exclusion from the venues, and any appropriate action.

Article 27 - Specific Provisions Relating to the Volunteer Area

The Site may provide an area dedicated to information, applications, selection, assignment, and monitoring of volunteers participating in the organization of the Games.

Applying as a volunteer implies full and unconditional acceptance of these Terms, as well as, where applicable, any charter, regulations, undertaking, specific conditions, or specific document applicable to the volunteer program.

27.1 Application Conditions

Applications to become a volunteer shall be submitted in accordance with the procedures, schedules, and forms defined by the COJ.

The applicant undertakes to provide accurate, truthful, complete, and up-to-date information, together with all documents that may be requested.

The COJ reserves the right to reject any incomplete, irregular, late, or manifestly non-compliant application.

27.2 Eligibility Criteria

The COJ freely determines the eligibility criteria applicable to the volunteer program, which may in particular relate to:

  • minimum age
  • legal capacity
  • availability
  • language or technical skills
  • fitness to perform certain assignments
  • respect for the values of the Games
  • production of supporting documents

absence of contraindications or incompatibilities for certain functions.

Compliance with the eligibility criteria does not confer any automatic right to be selected.

27.3 No Guarantee of Selection

Any application to the volunteer program shall be examined according to the COJ’s needs, constraints, and organizational choices.

The COJ remains the sole decision-maker with regard to:

  • the admissibility of applications
  • the selection of candidates
  • their assignment
  • the nature of the tasks entrusted

the place, schedule, and conditions of intervention.

Submitting an application, even if complete and admissible, shall in no event constitute a promise of selection, assignment, or actual participation.

27.4 Rules of Conduct

Any selected volunteer undertakes to adopt, in all circumstances, exemplary, loyal, respectful conduct consistent with the values of the Games.

In particular, they shall refrain from:

  • any violent, discriminatory, insulting, or disrespectful behavior
  • any breach of supervision, safety, or organizational instructions
  • any consumption of alcohol or prohibited substances, or presence under their influence during assignments where incompatible with the performance thereof
  • any statement, dissemination, or publication likely to harm the image, reputation, or proper conduct of the Games

any abusive use of the access rights, badges, equipment, or information obtained in connection with their assignment.

The volunteer undertakes to comply with all charters, codes of conduct, internal regulations, and instructions communicated to them.

27.5 Confidentiality

The volunteer undertakes to keep strictly confidential all non-public information of which they may become aware in connection with their assignment, in particular information relating to:

  • the organization of the Games
  • security arrangements
  • personal data
  • internal information
  • operational procedures
  • partners
  • delegations
  • accreditations

and more generally any sensitive or strategic information.

This confidentiality obligation applies throughout the duration of their participation and continues after the end of their assignment for as long as necessary to protect the COJ’s interests.

27.6 Image Rights

As part of the organization, promotion, archiving, and communication relating to the Games, the volunteer acknowledges that they may be photographed, filmed, or recorded.

Unless a legitimate objection is admitted under the conditions set out in the applicable documents and subject to any contrary mandatory provisions, the volunteer authorizes the COJ to capture, reproduce, and distribute their image, voice, and, where applicable, their name, on any medium and by any process, for institutional, informational, communication, promotional, or archival purposes related to the Games.

The precise terms of this authorization may be set out in a separate document or supplementary clause.

27.7 Insurance

The COJ may implement, under the terms it determines, insurance arrangements applicable to volunteers in connection with their assignments.

However, each volunteer remains responsible for verifying that they personally have appropriate coverage for their situation, in particular with regard to:

  • civil liability
  • personal injury
  • health
  • travel

or any other useful additional cover.

Unless the COJ expressly undertakes otherwise, no additional individual insurance is guaranteed solely by reason of submitting an application or participating in the program.

27.8 Expenses

Participation in the volunteer program shall not, unless expressly provided otherwise, create an employment relationship, remuneration, or compensation.

The COJ freely determines the conditions under which certain expenses, costs, meals, transport, equipment, allowances, or benefits may be covered, reimbursed, or provided to volunteers.

In the absence of an express decision by the COJ, no reimbursement of expenses shall be due.

27.9 Revocation, Suspension, or End of Assignment

The COJ reserves the right to suspend, reassign, limit, or terminate, at any time and without compensation, a volunteer’s participation, in particular in the event of:

  • breach of these Terms or of the applicable documents
  • inappropriate conduct
  • unjustified absence
  • loss of eligibility conditions
  • medical, security, organizational, or disciplinary grounds
  • operational necessity

or any situation deemed incompatible with the interests or proper conduct of the Games.

Likewise, the volunteer may withdraw from participation in accordance with the procedures that will be communicated to them, subject to compliance with any applicable obligations of information and return of property.

Article 28 - Availability, Maintenance, and Security

The COJ implements reasonable means to ensure the security of the Site.

However, the User acknowledges that the internet network is subject to technical hazards and inherent security risks, so that the COJ cannot guarantee:

  • the complete absence of anomalies, bugs, or vulnerabilities
  • the absence of interruption or malfunction
  • the absence of intrusion, infection, alteration, or fraudulent access

universal compatibility with all devices, browsers, systems, or versions.

The COJ may at any time carry out maintenance, testing, updating, migration, security, or development operations without incurring liability.

Article 29 - Liability of the COJ

To the extent permitted by law, the COJ shall not be held liable for damages resulting in particular from:

  • the use of the Site or the inability to use it
  • temporary or permanent unavailability
  • a technical malfunction
  • a compatibility defect
  • network interruptions
  • any error or omission in the content
  • the User’s use of the published information
  • an act attributable to a third party
  • force majeure

intrusion, hacking, a virus, or any cyber incident beyond its control.

In any event, if the COJ were to be held liable, such liability may only be incurred for direct, certain, and foreseeable damage, excluding any indirect or intangible damage.

Article 30 - Liability of the User

The User is solely responsible for:

  • their use of the Site
  • the information they submit
  • the consequences of their acts, omissions, or breaches

compliance with these Terms and applicable rules.

The User shall indemnify and hold the COJ harmless against any claim, action, proceeding, judgment, damage, loss, cost, or expense, including defense fees, resulting from:

  • a breach of these Terms
  • unlawful or abusive use of the Site
  • infringement of a third party’s rights

fault or negligence on their part.

Article 31 - Suspension or Restriction of Access

The COJ reserves the right, without prior notice or compensation, to suspend, restrict, or remove access to the Site or to certain Services, in particular in the event of:

  • non-compliance with these Terms
  • abusive, fraudulent, or unlawful conduct
  • harm to the security of the Site
  • risk to information systems

operational, technical, or regulatory necessity.

Such measure may be taken on a precautionary or permanent basis.

Article 32 - Evidence and Archiving

Computer records, logs, histories, technical journals, electronic acknowledgements, browsing traces, digital copies, and more generally any elements kept by the COJ under reasonable security conditions may validly be produced as evidence.

Article 33 - Accessibility and Continuous Improvement

The COJ endeavors to continuously improve the quality, ergonomics, accessibility, and usability of the Site.

However, unless expressly undertaken otherwise, it does not guarantee ongoing compliance with any specific technical accessibility standard.

Users are invited to report any difficulties encountered so that, where possible, the services may be improved.

Article 34 - Protection of Minors

Where certain sections or functionalities of the Site are accessible to minors, their use shall take place under the responsibility of the holder(s) of parental authority or the legal representative.

The COJ reserves the right to require, for certain services, any appropriate authorization or supporting document.

Article 35 - Reporting Unlawful Content or Use

Any person who considers that content, conduct, or use of the Site is unlawful, abusive, or contrary to these Terms may report it to the COJ at the following address: secretariat@tahiti2027.pf

The COJ reserves the right to take any measure it deems appropriate following such report.

Article 36 - Force majeure

The COJ shall not be held liable for any failure or delay in the performance of its obligations resulting from an event of force majeure or from an event reasonably beyond its control, in particular:

  • natural disaster
  • health crisis
  • major cyberattack
  • network interruption
  • hosting failure
  • fire
  • administrative decision
  • disturbance of public order
  • labor dispute

war or act of sabotage.

Article 37 - Partial Invalidity

If one or more provisions of these Terms are declared null, invalid, unenforceable, or non-binding, the other provisions shall remain in full force and effect.

The provision concerned shall, to the extent possible, be replaced by a legally valid provision reflecting the original intent as closely as possible.

Article 38 - No Waiver

The fact that the COJ does not rely, at a given time, on a provision of these Terms shall not be interpreted as a waiver of its right to rely on it at a later date.

Article 39 - Governing Law

These Terms are governed by the law applicable in French Polynesia, subject to any mandatory rules that may apply.

Article 40 - Dispute Resolution and Competent Jurisdiction

In the event of any dispute relating to the interpretation, validity, performance, or termination of these Terms, the parties shall endeavor to seek an amicable solution beforehand.

Failing an amicable agreement, any dispute shall fall within the exclusive jurisdiction of the competent courts under the Court of Appeal of Papeete, unless otherwise required by mandatory provisions.
